On September 24, 2014, the President of Ukraine signed the Law on the conversion of vacation homes into residential homes. What does this law give us? Given the current socio-economic and environmental factors, a significant portion of citizens are constantly living in their own garden and dacha houses, which are located near populated areas. Recently it has become possible to reconstruct garden and dacha houses, albeit at their own expense, as well as to connect all the necessary utilities, providing themselves with an actual place of residence in houses that meet all the requirements established for residential buildings and premises. However, previously the legislation did not allow to register a person in a garden or summer house, as such houses are not intended for permanent residence. And as you know, the place of residence directly affects the realization of the rights and freedoms of citizens, such as participation in elections, receiving social benefits and pensions, employment, medical care, education, postal services, etc.
All this will now become possible! Registration, re-registration, registration and re-registration of garden and dacha houses today will be necessary for those who, for personal reasons, live permanently on dachas, farmsteads and other exotic-communist constructions of the Soviet regime, as well as those who have no other permanent place of residence.
This law amends such normative legal acts as: the housing code, the civil code, as well as the law «On freedom of movement and choice of residence in Ukraine».
Registration, re-registration, as well as the transfer of garden and dacha houses is carried out according to the procedure established by the Cabinet of Ministers of Ukraine. Decisions on the transfer are made by the relevant local self-government bodies. Prior to the administrative-territorial reform, dacha settlements and gardening associations in suburban areas are accounted for the settlement with which they are connected in an administrative or territorial way.
These innovations, the conceptual idea of improving the Ukrainian legislation on the way to create conditions for the expansion of constitutional rights and freedoms of citizens of Ukraine, their implementation and guarantees.
